SCC-POL-013 · Version 1.1
Employment Rights and Modern Slavery Policy
Applies to: All employees, labour-hire workers, subcontractors and suppliers
1. Purpose
The cleaning industry has been identified by government and regulators as at higher risk of underpayment, sham contracting and modern slavery. Strata Cleaning Co is committed to paying workers correctly, respecting workplace rights and keeping exploitation out of our business and supply chain.
2. Your employment rights
- Pay and conditions — your minimum pay, penalty rates, allowances, breaks and other conditions are set by the Cleaning Services Award 2020 [MA000022] (or an applicable enterprise agreement) and the National Employment Standards (NES), which include maximum weekly hours, leave entitlements, notice of termination, the right to request flexible work, and the Fair Work Information Statement (and Casual Employment Information Statement for casuals).
- Payslips within one working day of payday, showing hours, rates and deductions. We keep employee records for seven years.
- Superannuation paid to your chosen fund at the required rate.
- Accurate time records — your hours are recorded through the Strata Cleaning App clock-in/out; if a time is wrong, tell your supervisor so it can be corrected before payroll.
- Freedom of association — you may join (or not join) a union and take part in lawful industrial activity.
- Casual work — your choice — as a casual you are offered shifts through the Strata Cleaning App and may accept or decline each one. Declining a shift or recording that you are unavailable will never be held against you: it won't reduce future offers or be treated as a performance or conduct issue. Once you accept a shift, please attend or tell your manager as early as possible if you can't (SCC-PRO-028). After the qualifying period you may notify us if you believe you are no longer a casual and wish to change to permanent employment; HR will respond in writing within the legal timeframe.
- Fair allocation of work — shifts are offered based on availability, site inductions, competence and fatigue rules, using the availability you record in the app — not favouritism. Raise any concern about how work is allocated with HR or under SCC-POL-010.
- Right to disconnect — you may refuse to monitor or respond to work contact outside your hours unless the refusal is unreasonable.
- Questions or concerns — speak to HR; you can also contact the Fair Work Ombudsman (13 13 94, fairwork.gov.au) for free information. You will not be treated adversely for asking about or exercising your rights (general protections).
3. Subcontractors
Subcontracted cleaners must be genuinely independent businesses (no sham contracting) and must pay their workers at least Award rates, superannuation and insurance. We require subcontractors to provide evidence of ABN, insurances, workers' compensation, and compliance with this policy, and we audit compliance (including site spot checks of worker pay and conditions).
4. Modern slavery
Modern slavery includes forced labour, debt bondage, servitude, deceptive recruiting, human trafficking, and the worst forms of child labour. Warning signs:
- a worker's passport or ID is held by someone else
- a worker owes a large "recruitment" or accommodation debt to a contractor
- wages withheld, paid in cash well below Award, or paid to someone else
- a worker is not free to leave, is transported and supervised everywhere, or seems afraid to speak
We will not engage, or continue with, any supplier or subcontractor that uses modern slavery practices. We assess risk in our supply chain (labour hire, subcontracted cleaning, uniforms, gloves and consumables), include modern slavery clauses in contracts, and train managers to recognise warning signs.
5. Reporting
Report concerns about underpayment, sham contracting or modern slavery to HR, a manager, or confidentially under SCC-POL-010 Whistleblower Policy. If someone is in immediate danger, call 000. The Australian Federal Police (131 237) accepts reports of human trafficking and slavery.
